1. Eligibility: This Thrive Market Research Participation Agreement (the “Agreement”) applies to all participants who complete the Thrive Market, Inc. (“Company”) research study and who will receive compensation as described in the applicable study invitation.
The Thrive Market Research Study Program is open to legal residents of the U.S., age 18 or older, who have reliable internet access and the ability to participate via Zoom as of the study commencement date.
Employees of Company and their respective parent companies, affiliates, subsidiaries, and their immediate family members and persons living in their same household, are not eligible to participate. Participation constitutes participant's full and unconditional agreement to these terms.
2. Study Participation Requirements: To receive compensation, participants must complete the full research session as described in the study invitation, including as applicable by participating via Zoom for the entire scheduled duration.
For Usability Studies: Complete all assigned tasks and provide requested feedback.
For User Interviews: Answer questions thoroughly and engage in discussion.
Participants must also provide valid contact information for compensation delivery.
3. Compensation Details: All participants who complete the study requirements will receive compensation as specified in the study invitation, typically ranging from $25 to $150 based on study type and duration.
If participants are active Thrive Market Members, they will receive Thrive Cash. If participants are no longer active Thrive Market Members, they will receive a prepaid gift card. Compensation will be delivered within 5-10 business days of study completion Thrive Cash will be added directly to your account, and gift cards will be sent via email. Participants who arrive on time for their scheduled session but have their session cancelled by Company will receive $15 in Thrive Cash or a gift card.
4. Recording and Data Usage Consent: By participating, you consent to the following: i) Audio/video recording of the research session, ii) Screen recording during usability studies, iii) Use of feedback and recordings for internal research and product improvement, iii) Anonymization of all data for analysis purposes, and iv) Retention of recordings for the maximum period permitted by applicable law for internal research purposes. You may withdraw consent and end participation at any time, but compensation is only provided for completed sessions.
5. Tax Responsibilities: Participants are solely responsible for any federal, state, and local taxes that apply to compensation received.
6. Privacy and Data Protection: Personal information collected will be subject to Thrive Market's privacy policy posted at https://thrivemarket.com/privacy-policy.
7. Limitation of Liability: By participating, you release Company from any liability arising from participation in research studies, including technical difficulties, scheduling conflicts, or compensation delivery delays. Company reserves the right to cancel or reschedule studies at any time, including but not limited to due to scheduling conflicts, technical issues, or operational needs. Participants will be notified as soon as possible and may be offered an alternative session.
8. Intellectual Property and Publicity Rights: By participating, you grant Company the right to use your feedback, suggestions, and anonymized quotes for internal research and product development. No additional compensation will be provided for such usage.
9. Disputes/Choice of Law: Participants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with this Agreement or the awarding of the prize shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Los Angeles, CA; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (iii) no punitive, incidental, special, consequential or other damages, including without limitation, lost profits, may be awarded (collectively, "Special Damages"); and (iv) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California Law, without reference to choice of law rules, governs the Sweepstakes and all aspects related thereto.by California law.
